Some scholars are of the view that if the zaani one who committed zina acknowledges the child, it is permissible to attribute him to him. There are two scholarly opinions regarding the case where the zaani acknowledges his son, if the woman is not married.
Ishaaq ibn Raahawayh was of the view that if the child who is born as a result of zina was not born to a married woman, and thus could not be attributed to the husband, and the zaani acknowledged him, then he was to be attributed to him. He said: He is to be flogged and the child is to be attributed to him. See also the answers to questions no. This view is more likely to be correct because that deed fornication had been committed by the two parties before Islam.
Therefore there is some doubt concerning this issue, and where there is doubt, it is permissible to attribute the child to the man who claims he is his son. But it is different when there is no doubt about the issue after Islam. If he is not attributed to you, for some reason or other, or you do not want that, then there is no blame on you in this case either.
Rather this is the basic principle and it is the view of the majority of scholars. The basic principle with regard to custody of a child before he reaches the age of discernment is that he should stay with his mother, then when he reaches the age of discernment he may be given the choice between his parents.
But if there is any risk of harm to the child if his mother is given custody of him, or if there is a greater purpose to be served by the child staying with his father, then custody is to be given to the father if possible. If you hope that your being given custody of the child or his being close to you will benefit him in religious terms, or encourage him to become Muslim, then you should strive to have him near you and soften his heart towards your religion, in the hope that Allah may save this soul from the Fire through you.
With regard to your situation, we think that the best way to follow is for you to try hard to take care of him and soften his heart by showing kindness and compassion, and showing that you take an interest in his affairs, so that he will see you as a good example of Islam and so that he will miss you if you are absent and will be happy to see you if you are present.
But if the law does not allow you to have custody of him and you are not able to have any influence over him, then we hope that there will not be any blame on you for that, in sha Allah.
Islam erases whatever came before it, and this child is the outcome of something that happened at a time of Jaahilyyah the sin of which Allah has erased from you, in sha Allah, by your becoming Muslim. So now you should focus on doing good in the future and making up for what you missed out on with regard to this child by raising your legitimate child properly and being kind to him. From your question we may note the following:. Do not follow in the footsteps of the Shaytaan, and do not get carried away thinking about her, let alone speaking to her on the telephone, let alone meeting her, let alone doing anything that is more serious than that. This is the best advice a person may be given, whether he is falling short in obeying Allaah, or he is doing something that earns the wrath of Allaah. This is what gives the one who is falling short the motive to strive, because when death comes, good deeds are no longer recorded.
It is sufficient for you to think of one thing: what if Allaah were to take your soul when you were masturbating while talking to this woman? What if Allaah were to take your soul when you were having unlawful intercourse with her? My brother, think about it. Do you want to come out of your grave on the day when mankind is resurrected, holding onto your private part? Beware of depriving yourself of the reward for these virtues by committing such a major sin that will bring the wrath of your Lord upon you.
Why are you not content with that which Allaah has decreed for you of permissible things? Your sin in doing these haraam deeds is worse than if you were not married. You are not single, rather Allaah has blessed you with the means of satisfying your desires in a permissible way. So whenever the Shaytaan makes you think of her the first womango to your wife and seek refuge with Allaah from the Shaytaan.
Get up in the latter part of the night and beseech your Lord, submitting yourself to Him and humbling yourself before His Majesty, asking Him to rid you of the problem. Turn to your Lord and call upon Him, for He is the best One to be asked — may He be glorified — and He does not turn away His slaves if they are sincere.
I hope that you will not be over-confident and think that you will be able to resist, for the one who is ruled by his desires is weak, and whoever walks for a few steps with the Shaytaan will walk with him to the end.
But you should know that you are incurring the wrath of the Compeller al-Jabbaar and that you are committing one of the gravest acts of disobedience against Allaah after shirk.

You will not find any adulterer who is pious, or keeps his promises, or speaks truthfully, or is a good friend, or has complete protective jealousy towards his family.
Treachery, lying, betrayal, lack of modesty, lack of awareness that Allaah is always watching, lack of chivalry, loss of protective jealousy from the heart — these are the effects and implications of zina. One of the effects of zina is that it earns the wrath of Allaah because His sacred limits are transgressed. If a man were to do such a thing to any king, he would meet the direst consequences. Another effect of zina is the darkening of the face, and the grimness and misert of face that are apparent to other people.

The Muslim has to fear his Lord in secret and in public, and keep away from that which Allaah has forbidden of being alone with a member of the opposite sex, looking, shaking hands, kissing and other haraam actions which lead to the immoral action of zina. So long as that has not happened, and the man has not uttered the word of divorce talaaq to his wife, or has not written words to that effect with the intention of divorcing her, then the woman is still his wife, even if the separation has gone on for a long time.
Shaykh Ibn Baaz may Allah have mercy on him was asked: When is a woman regarded as divorced? If a woman commits zina, it is not permissible for the one who knows of that to marry her unless two conditions are met:. They said: They are still zaanis whenever they are together, because of the general meaning of the verse and the report. It may be that what they meant by that was the period before they repent or before it is established that she is not pregnant, in which case it is the same as our view.
Because she is permissible in marriage for someone other than the one who committed zina with her, she is also permissible to him, like any other woman. It is not permissible for a Muslim to turn a woman against her husband because that leads to the breakup of families, even if there was a bitter dispute between the spouses. Some scholars regarded this as a major sin. This is also included in this hadeeth. The wise man should be careful with regard to such matters, even if his intention is good.
He said: I did this several times; I put pressure on the woman who was angry with her husband, and I advised my family to leave her hungry, so that she would go back and would appreciate how blessed she was with her husband. If a person turns a woman against her husband and spoils her for him so that she leaves him, then he marries her, his marriage is not valid and they must be separated, according to the view favoured by Shaykh al-Islam Ibn Taymiyyah may Allah have mercy on him.
